The legal authority for Planning Commissions in West Virginia is established under West Virginia Code §8A-2-1 et seq., which provides the framework for their creation, powers, and responsibilities.

  • Comprehensive Planning (§8A-3-1 et seq.) – The commission develops and maintains a Comprehensive Plan, which serves as a long-term blueprint for land use, infrastructure, transportation, and economic development in the county.
  • Subdivision & Land Development Regulations (§8A-4-1 et seq.) – It regulates the division of land, ensuring proper infrastructure, access, and utility services for new developments.

A Planning Commission is established by the County Commission through an ordinance or resolution.  Members are appointed by the County Commission and serve staggered terms.  It operates under adopted bylaws and meets regularly to review development matters.
